It was learned Monday that the Clemson offensive lineman Roman Fry was the one driving the waverunner that struck and killed Tigers assistant track coach Jarrett Foster Saturday evening on Lake Keowee.

Fry's attorney, Beattie Ashmore, said the incident is weighing heavily on the senior guard.

"He's having a tough time dealing with this," Ashmore said. "His focus, obviously, is dealing with the loss of a good friend of his."

A Natural Resources Department official said no charges have been filed against Fry, a senior, but that they have not been ruled out.

Lt. Robert McCullough said it didn't appear as though alcohol played a part in the accident as Fry passed field sobriety tests.

Toxicology tests with Foster are being handled by the State Law Enforcement Division.

Ashmore said though it was extremely unlikely that involuntary manslaughter or vehicular homicide are charges Fry could face.

Ashmore also said Fry, an All-ACC selection last season, has fully cooperated with authorities and that at least one further meeting is scheduled.

McCollough said Foster, 32, Fry, Matthew Powell and Nathan Bennett, another starting offensive lineman for the Tigers, were riding two waverunners when Foster fell off the back and was struck in the head by the one driven by Fry.

Ashmore said Bennett was driving the waverunner holding Foster.

A short time later, a call was placed to 911 at 8:50 p.m.

"Our thoughts and prayers are first with Jarrett Foster's parents and family," Clemson football coach Tommy Bowden said. "He was fine young man who had a significant positive impact on our track program and athletic department.

"This was a terrible accident. Our thoughts and prayers are also with Roman Fry and his family, as they also go through the grieving process."
